The 4.5-acre parcel in Los Altos Hills abutting Los Altos at Fremont Road and West Edith Avenue was approved for a three-lot subdivision by the Los Altos Hills City Council Aug. 21.

Los Altos residents Didier and Isabelle Rogez purchased the property and applied to Los Altos Hills to subdivide the land. The property has been under the Williamson Act, which allows for lower tax rates on land not pledged for housing development.

Abbey Ahrens, a Los Altos resident representing the property owner, emphasized the property tax was only $400 a year, but the property owners will have to pay $237,500 to the state after removal from the Williamson Act.

A number of Los Altos neighbors attended the review process and presented their concerns at the two public hearings by the Los Altos Hills Planning Commission. No one spoke against the subdivision.

Ahrens, owner of The Abigail Company real estate office, said the neighbors were particularly concerned about how drainage and future channel improvements will affect the creek.

The property was originally owned by Jonathan and Ada Hau who in 1991 applied to build a house that included a music hall for classical music concerts. The application was approved after considerable discussion by neighbors but was never built.
